Louisiana Laws on Rape

First degree rape is defined as nonconsensual sexual intercourse upon a person age 65 and older. It can involve but is not limited to:

  • Involves threat, force, or coercing

  • Victim under age 13

  • Victim is prevented from resisting

  • Can lead to life imprisonment

Second degree rape is defined as nonconsensual sexual penetration. It can involve but is not limited to:

  • Use of force/coercion, threats, or any type of harm
